Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legal agreement between you and HODA Construction Ltd. ("Company," "we," "us," or "our"). By accessing and using our website (hodaconstruction.com) and services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.
2. Our Services
HODA Construction Ltd. provides construction services including, but not limited to:
- Finish carpentry and custom woodworking
- New residential and commercial developments
- Renovation and remodeling projects
- General contracting and project management
Specific services will be outlined in individual project agreements and quotes.
3. Quotes and Estimates
Quotes provided by HODA Construction Ltd. are valid for 30 days from the date of issue unless otherwise specified. Quotes are based on the information provided and may be subject to change if project specifications change. Final pricing will be confirmed in the executed project agreement.
We reserve the right to adjust estimates if unforeseen conditions or changes in project scope are discovered during execution.
4. Project Agreements
All projects must be formalized through a written project agreement before work begins. The project agreement will specify:
- Project scope and specifications
- Timeline and project schedule
- Payment terms and total project cost
- Change order procedures
- Warranty coverage
- Insurance and bonding requirements
5. Payment Terms and Conditions
Payment terms are as specified in the project agreement. Typical terms include:
- Deposit upon signing of project agreement (typically 50% of project value)
- Progress payments as project milestones are completed
- Final payment upon project completion and client approval
If payment becomes 15 days overdue, we reserve the right to suspend work on the project until payment is received. Late payments may incur interest charges at the rate of 1.5% per month or the maximum rate allowed by law, whichever is less.
6. Changes to Project Scope
Any changes to the original project scope must be requested in writing and approved through a formal change order. Change orders will specify:
- Description of the change
- Cost impact and revised project total
- Timeline impact, if any
We are not obligated to proceed with changes until the change order is signed and any required additional payment is provided.
7. Warranty
HODA Construction Ltd. warrants all work to be free from defects in materials and workmanship for a period of one year from the date of project completion. This warranty covers:
- Structural integrity of work performed
- Material quality as specified in the project agreement
- Proper installation and finishing
This warranty does not cover:
- Normal wear and tear
- Damage caused by client negligence or misuse
- Changes made without our authorization
- Damage caused by third parties or acts of God
8. Client Responsibilities
By engaging HODA Construction Ltd., you agree to:
- Provide access to the project site during scheduled work hours
- Ensure the site is safe and free from hazards
- Provide accurate information about property conditions
- Make timely decisions regarding project details
- Comply with all applicable building codes and regulations
- Obtain all necessary permits before work begins (unless otherwise agreed)
9. Liability and Indemnification
HODA Construction Ltd. maintains full liability insurance for all projects. You agree to maintain property insurance on your home or business during the project. You further agree to indemnify and hold harmless HODA Construction Ltd. from any claims or damages arising from your negligence or failure to maintain property insurance.
10. Limitation of Liability
In no event shall HODA Construction Ltd. be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services, even if advised of the possibility of such damages. Our total liability shall not exceed the total amount paid for the project.
11. Dispute Resolution
Any disputes arising from this agreement shall first be addressed through good-faith negotiation between the parties. If negotiation fails, disputes will be resolved through mediation before pursuing legal action.
12. Cancellation and Termination
Clients may cancel a project by providing written notice. Cancellation fees will be calculated as follows:
- Within 3 days of agreement signing: Full deposit refund minus 10% administrative fee
- After 3 days: All costs incurred to date plus 15% project cost
- After work begins: All costs incurred to date plus 25% project cost
HODA Construction Ltd. reserves the right to terminate a project if payment obligations are not met or if working conditions become unsafe.
13. Intellectual Property
Any designs, drawings, or plans created by HODA Construction Ltd. remain our intellectual property unless otherwise agreed in writing. Clients may use materials for their own project but may not reproduce, distribute, or use them for commercial purposes without permission.
14. Licensing and Insurance
HODA Construction Ltd. is fully licensed and insured as required by law. We maintain:
- General liability insurance
- Workers' compensation insurance
- All required bonding and permits
Proof of insurance will be provided upon request.
15. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services following the posting of revised Terms means you accept and agree to the changes.
